The field of insolvency and bankruptcy laws have garnered much attention over the years ever since Kingfisher Airlines went bankrupt. The people started wondering what exactly happens to a dying company looking for a winding up. Does the law intervene to help the dying companies? If yes, how does it help? What about those who have invested in the companies and their investments tanked or the creditors who never got their dues, or simply the employees who did not receive their deserving salaries. This is where insolvency and bankruptcy laws become relevant, which have answers to all these questions.

Such insolvency and bankruptcy laws that primarily involve the Insolvency and Bankruptcy Code, 2016, and other allied legislations prescribes a process to revive the dying and sick companies called the Corporate Insolvency Resolution Process [CIRP]. CIRP is carried out by trained and qualified Resolution Professionals and gives ample opportunities to the regular practitioners to represent dying companies or creditors before the courts and tribunals. Therefore, insolvency and bankruptcy are promising niche fields with lots of unharnessed potential and opportunities for young practitioners and budding lawyers looking for exciting avenues in law.

As usual, this field of law is unexplored through the regular law school curriculum, and lawyers find it difficult to start their practice right away in the NCLTs without a proper understanding or training of the insolvency and bankruptcy laws. Keeping that in mind, WizLaw Academy, in collaboration with leading practitioners and industry leaders, has curated an exclusive and industry relevant skill based course on insolvency and bankruptcy laws to provide participants with an in-depth functional and practical understanding of the Insolvency and Bankruptcy Code, 2016 and relevant provisions of the allied legislations. The course will guide a participant to cumulatively and comprehensively understand the CIRP Process and how it plays out in practice.

This course aims to provide participants with an overview of the rationale behind the key provisions of the Code and their practical application. Therefore, the course will provide participants with multiple fact situations (both in contentious and non-contentious contexts) and aim to provide participants with an understanding of the Code, which will enable them to apply these learnings in real-world situations. The course would be of use to those who wish to pursue commercial litigation, corporate lawyers who are certain to face some of these issues in an advisory capacity, or in the course of structuring and executing transactions.

Broadly, the course will acquaint participants with strategies to initiate insolvency proceedings against debtors, act for debtors to defend insolvency actions, advise restructuring companies using the Code, and evaluate various recovery methods against companies already in insolvency/liquidation.
